Inheritance Attorney in Raleigh
Planning What You Leave Behind & Protecting What You’re Owed
Inheritance law works in two directions. One is forward-looking: deciding who receives your assets through a will, a trust, or a carefully structured plan. The other is immediate: helping a beneficiary pursue what they’re entitled to. At Monks Law Firm, PLLC, we help Raleigh and Cary families with both, under one straightforward, fixed-fee relationship.
We assist personal representatives and beneficiaries with North Carolina’s probate procedures, and we draft estate plans that keep distribution in your hands rather than leaving it to a default legal formula.
Whether you’re planning ahead or dealing with an inheritance matter right now, we’re ready to help. Call (888) 386-5135 to schedule a free consultation in person or virtually.
Why Raleigh Families Work with Monks Law Firm, PLLC
Steve Monks has practiced estate planning law in North Carolina for more than 37 years. That depth of experience matters when you’re navigating an unfamiliar process, whether you’re writing a will for the first time or trying to understand why an estate has stalled. We charge fixed, transparent fees so you know the cost before any work begins, and our free initial consultation carries no obligation. Flexible scheduling includes evening and weekend appointments, and we meet clients virtually or in person.
When There’s No Will: North Carolina’s Intestacy Rules
Without a valid will, North Carolina’s Intestate Succession Act (Chapter 29 of the General Statutes) determines who inherits. The statute distributes assets according to a fixed hierarchy of relatives, and the results don’t always match what a family would have chosen.
A surviving spouse’s share depends on who else survives the decedent:
- No children or parents surviving: The spouse inherits 100% of real and personal property
- One child surviving: The spouse receives the first $60,000 of personal property value plus half of the remainder, with the balance passing to the child
- Multiple children or a surviving parent: The spouse’s share is reduced further under the statute’s formula
A surviving spouse also has the option to take a life estate in one-third of the decedent’s real property instead of the intestate share. That choice carries significant long-term consequences, and it’s one we can help you think through carefully.
Our approach focuses on understanding your family’s needs and values so your plan reflects what truly matters to you.
When a Beneficiary Isn’t Receiving What They’re Owed
An executor has a fiduciary duty to the estate’s beneficiaries, and North Carolina law can hold them personally liable for mistakes or misconduct. When an executor is unresponsive or appears to be mismanaging an estate, beneficiaries have legal options, and we can pursue them.
Here’s how we help beneficiaries protect their inheritance:
- Demanding transparency: We can compel an executor to produce the estate Inventory and Accountings, showing exactly what the estate holds and how funds are being spent
- Contesting a will: If you believe a will is the product of undue influence, fraud, or lack of mental capacity, we can file a caveat proceeding in Superior Court to challenge its validity
- Compelling distribution: When an estate is ready to close but an executor is withholding an inheritance, we can file a motion to compel distribution
- Clarifying ambiguous language: If a will is poorly drafted and your entitlement is unclear, we can ask the court for a declaratory judgment addressing what you may be entitled to receive
