Trusts

Trust Lawyer in Raleigh, NC

A trust is a flexible estate planning tool that allows you to manage, protect, and distribute assets according to your instructions, often with greater control and efficiency than a will alone. In North Carolina, trusts are governed primarily by the North Carolina Uniform Trust Code and can be structured to address a wide range of financial, family, and tax concerns.

At Monks Law Firm, we help clients in Raleigh and the surrounding areas create and update estate plans that include various types of trusts. We can determine whether a trust is appropriate for your circumstances and, if so, design a structure that aligns with your goals.

How We Can Help with Establishing a Trust

At Monks Law Firm, we take a methodical approach.

  • Evaluation: We begin by evaluating your assets, family structure, and objectives so we can determine whether a trust is necessary or whether simpler tools would suffice.
  • Strategic design: If a trust is appropriate, we explain available structures and recommend a design tailored to your goals, not a general template.
  • Drafting and review: We prepare the trust document in compliance with North Carolina law and review it carefully with you for clarity and alignment with your wishes.
  • Execution and funding guidance: Creating a trust is only part of the process. Assets must be properly transferred into the trust. We guide you through funding to make the trust function as intended.
  • Ongoing updates: Life changes. We assist with amendments or restatements when circumstances evolve.

Thoughtful Planning for the People You Love Supporting families through important life decisions.

Our approach focuses on understanding your family’s needs and values so your plan reflects what truly matters to you.

Funding the Trust (Without This Step, The Trust is Just an Expensive Piece of Paper)

As part of our representation, we assist you with “funding” your trust. What sets our firm apart is that we don’t just prepare documents, we help ensure your plan is actually carried out by guiding you through the process of transferring assets into your trust.

We provide clear instructions and advice on how to transfer assets into the trust and, where possible, complete certain steps for you, including preparing and filing your deed. We also remain available to assist you for 90 days after your documents are completed to help you make progress and ensure nothing important is overlooked. In addition, we review assets such as retirement accounts, insurance policies, and other beneficiary-designated accounts to determine how they may be aligned with your trust. Once we identify the appropriate approach, we will advise you on next steps or, if you prefer, complete the necessary work on your behalf as an additional service.

We will also counsel you on whether specific assets should be placed into the trust. For items that require your personal presence—such as updating a vehicle title at the DMV or changing ownership of bank accounts—you will be responsible for completing those steps, with our guidance along the way.

Types of Trusts in North Carolina

Trusts can be customized extensively.

Common types used in North Carolina include:

  • Revocable living trusts – Created during your lifetime and modifiable while you are alive and competent. Frequently used to avoid probate and manage assets during incapacity.
  • Irrevocable trusts – Generally cannot be modified once established; often used for asset protection or tax planning.
  • Gun trusts - Designed to safely hold and transfer ownership of firearms.
  • Testamentary trusts – Created within a will and effective upon death.
  • Special needs trusts – Designed to benefit a disabled individual without jeopardizing eligibility for government benefits.
  • Charitable trusts – Structured to benefit charitable organizations while offering potential tax advantages.
  • Spendthrift trusts – Protect beneficiaries from creditors and from mismanaging inherited funds.
  • Asset protection trusts – Used in specific planning strategies to shield assets from future claims.
  • Credit shelter/bypass trusts – Historically, used in estate tax planning for married couples.
  • Generation skipping trusts – Designed to transfer wealth to grandchildren or later generations efficiently.

Not every client needs a trust, and not every trust structure is appropriate for every situation. Proper analysis is essential.

Benefits of a Trust

When properly structured and funded, a trust can:

  • Avoid the probate process
  • Provide ongoing management if you become incapacitated
  • Maintain privacy (unlike probate filings)
  • Offer greater control over timing and conditions of distributions
  • Reduce family conflict through clear instructions
  • Provide asset protection in certain circumstances
  • Assist in tax-efficient wealth transfer (when applicable)

Trusts can also provide peace of mind by ensuring assets are handled consistently and in accordance with your written plan.
