What a Complete Special Needs Plan Includes

Most families are familiar with the special needs trust (SNT) as the centerpiece of disability planning, and it is central. But the trust doesn’t operate alone. Before recommending a structure, we evaluate the family’s financial situation, the beneficiary’s existing benefit status, and long-term support needs. A complete plan typically involves several coordinated documents.

Third-Party vs. First-Party Trusts
A third-party special needs trust is funded with assets belonging to parents, grandparents, or other family members and requires no Medicaid payback at the beneficiary’s death. A first-party special needs trust is funded with the beneficiary’s own assets, such as a personal injury settlement, and must include a Medicaid payback provision under federal law. We draft both, depending on the family’s circumstances.

Coordinated Wills
If a parent’s will leaves assets directly to a disabled child, that distribution can trigger a loss of government benefits. We align wills across the family so assets can flow into the trust structure, not around it.

Guardianship and Decision-Making Authority
When a primary caregiver is no longer able to act, someone must be authorized to make personal decisions for the disabled individual. Guardian and conservatorship designations address this directly. Without them, families often face a court process at the worst possible time.

Letter of Intent
A letter of intent isn’t a legal document, but it’s one of the most practical things a family can prepare. It documents the beneficiary’s daily routines, medical needs, preferences, and relationships so future trustees and caregivers have what they need to provide consistent care.

How Benefit Preservation Works in a Special Needs Plan

SSI imposes a resource limit on individual recipients. Assets held in a properly drafted special needs trust aren’t counted toward that limit because the beneficiary doesn’t own or control the trust assets directly. When the trust is correctly structured, those assets can be excluded from SSI and Medicaid resource calculations. The same principle applies to Medicaid eligibility in North Carolina, which is administered by the NC DHHS Division of Health Benefits and mirrors SSI asset rules for many recipients.

What the trust can and can’t pay for matters just as much as the structure itself. Permissible distributions typically cover supplemental needs not funded by government programs: therapies not covered by insurance, assistive technology, transportation, educational support, recreational activities, and specialized medical care. Distributions that substitute for benefits the government would otherwise provide can reduce the beneficiary’s SSI payment, most notably direct payments toward shelter costs such as rent, mortgage, or utilities. As of September 30, 2024, the Social Security Administration no longer counts food provided to a beneficiary as income for SSI purposes, which means trustees now have more flexibility to pay for groceries and meals without triggering a benefit reduction. Proper administration still requires understanding where those lines fall.

Online templates and generic forms frequently lack the precise language federal benefit eligibility standards require. The cost of a poorly drafted trust isn’t just the document itself. It can include benefits lost and the legal work required to fix the problem later.

Special Needs Planning vs. a Special Needs Trust

A special needs trust holds and distributes assets. It doesn’t address who makes decisions for the disabled individual, what the trustee needs to know about their daily life, or whether a parent’s retirement account is pointed at the right beneficiary. These are the gaps a complete plan closes.

A full special needs plan typically coordinates a special needs trust, updated wills for both parents, durable powers of attorney, healthcare directives, guardianship or limited guardianship designation, and a letter of intent. Each document serves a distinct function. Together, they cover the legal, financial, and personal dimensions of long-term care.

Families should also review all existing beneficiary designations on life insurance policies, retirement accounts, and other financial instruments. If any of those assets pass directly to the disabled individual outside the trust structure, the plan has a gap that could cost the beneficiary their government benefits.

ABLE accounts are a complementary savings tool now available to individuals who became disabled before age 46, a threshold expanded from age 26 by the ABLE Age Adjustment Act, which took effect January 1, 2026. Contributions up to the statutory annual limit may not disqualify the account holder from SSI or Medicaid and can be used alongside a special needs trust to cover qualified disability expenses. For families building a complete plan, ABLE accounts are worth including in the conversation.

Long-term planning should also account for transitions: turning 18 and aging out of pediatric services, leaving school-based programs, and changes in the caregiver’s own health or financial situation.
