What a Complete Special Needs Plan Includes

Most families are familiar with the special needs trust (SNT) as the centerpiece of disability planning, and it is central. But the trust doesn’t operate alone. Before recommending a structure, we evaluate the family’s financial situation, the beneficiary’s existing benefit status, and long-term support needs. A complete plan typically involves several coordinated documents.

Third-Party vs. First-Party Trusts
A third-party special needs trust is funded with assets belonging to parents, grandparents, or other family members and requires no Medicaid payback at the beneficiary’s death. A first-party special needs trust is funded with the beneficiary’s own assets, such as a personal injury settlement, and must include a Medicaid payback provision under federal law. We draft both, depending on the family’s circumstances.
