What Is a Revocable Living Trust?

A revocable living trust is a legal entity you create during your lifetime. When you transfer assets into the trust, the trust becomes the legal owner of that property. As the grantor, you retain full control. You can modify the terms, change beneficiaries, add or remove assets, or revoke the trust entirely at any time while you’re alive and mentally competent.

Two situations make a revocable trust especially valuable. If you become incapacitated, your named successor trustee steps in to manage trust assets without any court involvement, which can avoid the cost and delay of a court-supervised guardianship. When you pass away, the successor trustee distributes assets to your beneficiaries according to the trust terms, outside the North Carolina probate process.

Core Benefits of a Revocable Living Trust

Probate avoidance is the most commonly cited benefit, and it’s significant. Assets held in the trust pass directly to beneficiaries without a probate proceeding, which can mean no court timeline, no public filing, and no probate fees eating into what you leave behind. Unlike a will, a trust doesn’t become part of the public record, so the details of your estate and your beneficiaries stay private.

A revocable trust also gives you control over how and when distributions happen. You can require that a minor child reach a specific age before receiving funds, or structure distributions over time rather than as a lump sum. And because you actively managed the trust during your lifetime, it’s generally harder for a disgruntled heir to challenge than a will.

One important trade-off: a revocable living trust doesn’t protect assets from creditors and doesn’t improve eligibility for Medicaid or other government benefit programs.
