When Assets Were Left Outside the Trust

An underfunded trust is one of the most common and most preventable problems in trust administration. When a trust was created but never fully funded, meaning assets weren’t properly retitled into the trust during the grantor’s lifetime, the successor trustee is left with assets that can’t simply be transferred under the trust’s terms.

How those outside assets are handled depends on how they’re titled. Retirement accounts, life insurance policies, and accounts with payable-on-death or transfer-on-death designations typically pass directly to the named beneficiary, bypassing both the trust and probate. But real property never deeded into the trust and bank or brokerage accounts without a trust title or beneficiary designation may require a court-supervised probate proceeding in the county where they’re located before title can be transferred or funds distributed.
